DANCEANDEDUCATION.COM EVENT SELLER/ORGANIZER TERMS OF USE AND AGREEMENT
Event Organizer and/or ticket seller agrees to all of the following danceandeducation.com (dance&education) terms and policies:
Services and Responsibilities
dance&education provides the following services to sellers/organizers:
1. displaying, listing and promoting events as submitted by the event organizer, promoter, producer, presenter, or manager (collectively “Organizer”);
2. accepting, selling and processing securely on¬line orders for tickets to the event produced by Organizers;
3. providing Organizers with a confirmation number of the transaction and the buyer and ticket holder personal information.
4. providing Organizers with a order barcode and a different barcode on each ticket to confirm attendances of the events and
5. with the technology to archive all attendances details for future events.
Organizer
Event Organizer, promoter, ticket seller, venue representatives, or other authorized agents providing services or events for which tickets are sold are hereinafter referred to as “Organizer”. Organizers using dance&education ticket selling services agree and understand these terms are a legal, binding, and enforceable agreement. Organizer agrees they are authorized to sell tickets for events or services. Fraudulent representation by a Organizer, or of event(s), is a criminal offense, which voids this agreement and allows dance&education to fully refund tickets to ticket purchasers. dance&education will assist law enforcement in prosecuting any fraudulent use of dance&education ticket sales services, and will legally seek any and all compensation for damages due to fraudulent representation.
dance&education and Organizers
dance&education is not affiliated with any Organizers for which tickets are purchased. dance&education is solely acting as a ticketing service provider between Organizer and ticket buyer for specific events. dance&education assumes no liability incidental to the event for which tickets are sold or purchased.
Scope of Agreement and Amendments
This agreement is limited to the individual event for which Organizer is using dance&education ticket sales services (with exception to terms “Event Cancellation”, if it applies). dance&education reserves the right to change or modify the Organizer terms of use and agreement at any time for subsequent events.
Ticket Pricing
There is not initial fees or start-up charges to use dance&education ticket sales services by Organizers. Ticket pricing is solely determined by Organizer. Organizer is exclusively responsible for all city, municipal, county, district, state and federal taxes.
Ticket Buyers Fees
The event Organizer sets event ticket prices, not dance&education. Processing card (Stripe and PayPal) and dance&education administration service fees are together included on the total price of each ticket. This fee could be 4% for processing card and service fee or 0.99€ if ticket buyer select Bank Transfer to Organizer’s payment method.
In addition, ticket buyers may face a currency conversion-handling fee, which the bank charges during processing the payment.
Ticket Availability and Over Sale Charges
Organizer is solely responsible for setting the number of tickets available for purchase for each event. Organizer agrees that the number of tickets for sale is within the legal fire regulations and venue capacity limitations as set forth by the city, municipality, county, district, state, and/or federal codes and/or laws. If over sales of tickets occur, Organizer agrees the full ticket price, plus any and all dance&education services fees, will be refunded to ticket buyers holding unused/un-scanned tickets. Organizer further agrees that Organizer will pay dance&education for the full ticket price and refunded service fees for tickets that are refunded due to over sale, and that said totals will be deducted from the total face value event ticket sale amount to be paid to Organizer. dance&education reserves the right to withhold payment to Organizers for up to 90 days after an event ends for events where tickets were over sold in order to provide refunds as necessary.
Event Cancellation
Organizer agrees to notify dance&education immediately after the decision to cancel an event is made. dance&education reserves the right to issue full refunds to ticket purchasers, including service fees, for the canceled event. Organizer agrees that if an event is canceled and full refunds are issued to ticket buyers, Organizer will pay dance&education for any and all service fees originally charged to the ticket buyer, and additional costs, including but not limited to, credit card charge back fees related to refunding tickets. Organizer may offer replacement tickets for similar event(s) in place of a refund for the canceled event. However, ticket buyer is not obligated to accept replacement tickets in the place of a full refund.
Rescheduled Events
Organizer agrees refunds will be given to ticket buyers for rescheduled events at the ticket buyer’s request. Should a ticket buyer request a refund due to a rescheduled event, Organizer agrees to pay dance&education for any and all service fees originally charged to the ticket buyer, and costs, including but not limited to any and all credit card charge back fees related to refunding tickets due to rescheduled events.
Change of Event Venue or Change of Event
Should the listed event venue change for any reason; Organizer agrees that refunds will be given to ticket buyers at the ticket buyer’s request. Additionally, should there be a change in the event, Organizer agrees that refunds will be given to ticket buyers at ticket buyer request. Should a ticket buyer request a refund due to an event venue change or event change, Organizer agrees to pay dance&education for any and all service fees originally charged to the ticket buyer, and costs, including but not limited to, any and all credit card chargeback fees related to refunding tickets due to a change in the event venue or the change in the event.
Ticket Refund Policy
Organizer agrees that at the event ticket buyer’s request, and at dance&education’ sole discretion, dance&education may refund the face value of event tickets purchased through dance&education until ticket sales for that event end. Event ticket sales are final after sales have ended.
Payment Methods
The payment methods used in dance&education are:
Credit Card processing by Stripe.com
PayPal Checkout Express and
Bank Transfer to Organizer payment.
Fees: Processing Card Fee and Administration Fee
There is not initial fees or start-up charges to use dance&education ticket sales services by Organizers. dance&education get profit once an event ticket is sold.
Total value of each ticket sold by card includes a 4% fee. This fee comprise the following two fees:
(1) Payment processing fee (for Stripe and PayPal)
(2) and administration service fee (for dance&education)
Each ticket sold via Bank Transfer to Organizer’s payment method has a fee of 0.99€ per ticket.
The 4% or 0.99€ fee will be deducted from the ticket’s price set by Organizer or added if Organizer decide that ticket buyers will pay the fee. Organizer must bear in mind this conditions while setting a price for a ticket.
In case all or the majority of purchased tickets were made via Bank Transfer to Organizer payment method, the Organizer agrees to pay to dance&education each ticket fee for the services and the use of Bank Transfer to Organizer payment method.
Payout to Organizer
Generally, total payment to Organizers for event tickets purchased will be pays out 2 day after the start of the event. It will be direct deposited into Organizer’s bank account or PayPal account.
As it arrive payout to organizers is also possible. Every time a customer make a purchase via PayPal payment method, the money can immediately be transferred to organizers’ PayPal account. For it, organizers must provide his/her email account associated with a PayPal account.
Limitation of Liability
Organizer understands and agrees that dance&education shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if dance&education has been advised of the possibility of such damages).
Disclaimer of Warranties
Organizer understands and agrees that dance&education ticketing service is provided on an “as is” and “as available” basis, and that dance&education assumes no responsibility for the timeliness, deletion, failure to store, or retention of any user communications or personalization settings. dance&education will not be liable for failure to perform any obligation under this Agreement if such failure is caused by Internet outages or delays, unauthorized access (hacking), earthquakes, communications outages, fire, flood, war, an act of God, or the occurrence of any other unforeseen contingency beyond the reasonable, control of dance&education.
Ownership of Intellectual Property
Organizer agrees not to post material that Organizer does not have an ownership right of patent, copyright, and/or other intellectual property right to. dance&education reserves the right to remove any content from an event page or custom Organizer page that may infringe on the intellectual property rights of a third party.
Debit and Credit Card Information
Debit and credit card holder information is handle and protected by Stripe Payments Europe, Ltd. (Stripe) and Paypal.com. dance&education doesn’t keep or collect any of the debit or credit card holder information.
Changes
dance&education reserves the right to amend this agreement at any time.
